Clarence Richard Company owns AsphaltAuction.com and is allowing Free Listing of Equipment and Employment Opportunities to Asphalt Mix Producers and or Paving Contractors from November 1, 2007 until it is decided some time in the probable far off future not to be Maintained as a free site. Any listings made during this time will always be considered free of charge.

Therefore the terms as indicated below and on the AsphaltAuction.com site are null and void.

AsphaltAuction.com welcomes your interest in our services. At no charge, Buyers may shop this site.

We are advertising the sale of equipment for Sellers. When the equipment is sold, we are paid by the seller an 8% advertising fee (6% of the sold equipment price for all sales over $500,000) within thirty days of the bid closing. AsphaltAuction is only an advertiser being compensated for it’s services from a percentage of the sale. AsphaltAuction assumes absolutely no liability in the sales transaction.

Buying/Selling procedure: It is strongly recommended that all items placed on the site be available for sale while being listed. For whatever reasons; they may not be available when you want to place a bid. Buyers: It is prudent to request of the Seller a written equipment condition, shipping assistance and availability agreement before placing a bid.

The registrant’s and equipment information are correct to the best of our knowledge. Asphalt Auction assumes no responsibility to the Buyer or Seller. It is the registrant’s obligation to verify sales information.

Sellers are encouraged to provide pictures of their equipment for display on Asphalt Auction.com. These pictures may be e-mailed or sent in the mail. Some e-mail pictures may have to be format converted, color and resolution adjusted and sometimes cropped for website purposes. AsphaltAuction has the right to use it’s best judgment on presenting the pictures.

AsphaltAuction Rights
When Sellers submit their equipment for auction; they must keep the equipment in saleable condition until the bid close date. Submitted equipment must be taken out of significant production. Significant negative changes, such as usage and wear and tear, is not allowed.

AsphaltAuctions.com reserves the right to alter posted closing times, or to remove from sale or re-offer for sale items which are disputed, withdrawn by the Seller, or fail to draw bids.

AsphaltAuction.com reserves the right to reject or void equipment registrations, that it deems not to be made in good faith.

The failure of the seller or buyer to perform shall be considered at default and shall be liable to AsphaltAuction for all related damages. AsphaltAuction.com shall not be liable for consequential damages to Sellers and Buyers.

Buyers and Sellers acquire information from AsphaltAuction.Com services. Sellers are not allowed to sell registered equipment to Buyers without fully compensating AsphaltAuction for their services. When AsphaltAuction.com suspects for any reason that a Seller is selling equipment around AsphaltAuction.com, Asphalt Auction.com reserves the right to demand upon request from any registered seller a proof of ownership or if sold, Seller to provide a bill of sale and cancelled check. AsphaltAuction.com logs every Buyers’s interest (every time a Buyer examines a particular item on a particular Bid Sheet) in a Seller’s equipment in the AsphaltAuction.com database.

If Seller claims to have had contact with a buyer previous to acquiring knowledge Asphalt auction.com and buyer is a AsphaltAuction.com Registered User and Seller wants to sell directly to Registered User witout compensating AsphaltAuction.com; Seller must provide phone company verifiable telephone conversation logs from Seller’s phones to and/or from Buyer’s phones.

User Rights
When equipment is still available for sale, the bidder (bidder’s agent or appraiser) has the right to see the equipment in person. Bidder must make arrangements with the Seller. Seller must reasonably accommodate Buyers.

Other than interested, verified users; Asphalt Auction.com does not disclose user identities and information to others.

Buyers; when deciding on a User ID, pick a code name you can remember but your competition will have difficulty associating you to the User ID name. Your User ID name shall be posted on the auction screen and viewed only by registered users.
